Polly Insurance Rewards Program Participant Terms of Use

Please read the following Terms of Use carefully. "You" and "Your" refer to the person or persons agreeing to these Terms of Use. These Terms of Use are in addition to any other agreements between You and Polly Insurance Agency, LLC (“Polly”), including the Terms of Use associated with Your Polly account and Polly’s Privacy Policy. By participating in the Polly Insurance Rewards Program (“Program”), You agree to be bound by these Terms of Use and any subsequent revisions. If You do not agree with any of these Terms of Use, You may not participate in the Program. We reserve the right to modify these Terms of Use at any time. Continued participation in the Program will constitute Your acceptance of any revisions to the Terms of Use. Please check these Terms of Use regularly.

Program Description

Polly administers reward opportunities (“Offer”) under the Program to persons that provide Polly with insurance lead opportunities. Offers are made at Polly’s discretion and that support its business initiatives. Offer details are provided on the site where You engage with such Offer (“Offer Site”). We reserve the right to modify the terms of the Offer at any time.

Permitted Use of the Offer Site

Polly will permit You to use the Offer Site to participate in the Program. You agree that You are responsible for, and agree to comply with, any applicable federal, state and local laws or regulations relating to your participation in the Program or use of the Offer Site. You agree to access and use the Offer Site solely for the purpose of participating in the Program.

Your Responsibilities

You acknowledge and agree that You are not an employee of Polly or any company owned or controlled by or under the common control of Polly. You acknowledge and agree that You are not eligible for, nor shall participate in, any retirement, health, disability, unemployment or other fringe benefit plan or program applicable to employees of Polly.

You represent that You shall accurately and timely make all reports, filings and payments required by law or regulation by any competent taxing authority, local, state or federal, related to the receipt of income and revenue hereunder. You further represent and agree that payments made to You shall not be deemed wages paid to an employee of Polly for any local, state or federal income, FICA, FUTA or similar tax purposes, and that Polly shall not withhold any portion of such payments for tax purposes.

You acknowledge that you are participating in the Program voluntarily and that you are not participating in a “controlled game” as may be defined by law. You acknowledge that you are not giving up anything of value in order to participate in the Program.

You understand and acknowledge that Your participation in the Program may require the reporting of Your reward payments to the Internal Revenue Service and that You may be issued a 1099 Form for such payments.

Termination of Program or Offer

Polly may, in its sole discretion and at any time, terminate or suspend the Program or an Offer, or Your participation in the Program or an Offer for any reason, with or without prior notice.
